Nadhif, including its source code, object code, compiled application, command
line tool, scripts, rules, signatures, documentation, user interface, texts,
translations, icons, graphics, website and all other materials (together, the
"Software"), is proprietary and confidential. The Software is the exclusive
property of Alhamou and is protected by copyright, trade secret and other
intellectual property laws and international treaties. The Software is
licensed, not sold.
1. Source code. No right of any kind is granted in the source code. The source
code is a trade secret of Alhamou. You may not access, view, open, copy,
download, read, modify, translate, adapt, compile or distribute it, in whole
or in part, unless Alhamou has authorised you to do so in writing (for
example under an employment or contractor agreement), and then only for the
purpose and for the time stated in that authorisation.
2. Use of the application. Subject to your continued compliance with this
license and with the Nadhif Terms of Use (TERMS.md), Alhamou grants you a
limited, personal, non-exclusive, non-transferable, non-sublicensable and
revocable license to install and run the compiled application, as published
by Alhamou, on Mac computers that you own or control, for your own personal
or internal business purposes.
3. Restrictions. Except to the extent that applicable law expressly permits it
despite this restriction, you may not, and may not allow anyone else to:
(a) reverse engineer, decompile, disassemble, decrypt or otherwise attempt
to derive the source code, algorithms, rules or signatures of the
Software;
(b) modify, patch, adapt, translate or create derivative works of the
Software, or remove or bypass any of its safety checks, verifications,
confirmations or technical limits;
(c) copy the Software, except for one backup copy of the application;
(d) sell, rent, lease, lend, sublicense, distribute, publish, mirror,
re-host or otherwise make the Software available to any third party,
including as a service;
(e) remove, alter or obscure any copyright, trademark or proprietary notice;
(f) use the Software, or any part of it, to build a competing product;
(g) use the Software in breach of the Terms of Use or of any law.
4. Ownership. All rights, title and interest in and to the Software, including
all copies, updates and derivative works, remain with Alhamou. All rights
not expressly granted in this license are reserved. The names "Nadhif" and
"نظيف", the Nadhif logo and the Alhamou name are marks of Alhamou and may
not be used without prior written permission.
5. Termination. This license ends automatically, without notice, if you breach
any of its terms or the Terms of Use. On termination you must stop using
the Software and delete every copy in your possession or control.
6. No warranty. The Software is provided "as is" and "as available", without
warranty of any kind, express or implied, including the warranties of
merchantability, fitness for a particular purpose and non-infringement, to
the maximum extent permitted by applicable law.
7. Limitation of liability. To the maximum extent permitted by applicable law,
Alhamou shall not be liable for any indirect, incidental, special,
consequential or punitive damages, or for any loss of data, profits,
revenue or business, arising out of or in connection with the Software or
this license. Nothing in this license limits liability that cannot be
limited under applicable law, such as liability for intent, gross
negligence or injury to life, body or health.
8. Terms of Use and Privacy Policy. The Nadhif Terms of Use (TERMS.md) and
Privacy Policy (PRIVACY.md) form part of this license. If they conflict with
this license about the source code, this license prevails.
Any use of the Software not expressly permitted by this license is prohibited
and may result in civil and criminal liability.
